Terms of Use (User Agreement)

These Terms of Use govern your access to and use of the Etkin.app platform (the “Service”). By accessing or using the Service, you are deemed to have accepted these terms. Paid subscription purchases are additionally subject to the Preliminary Information Form and the Distance Sales Agreement; the processing of personal data is subject to the Privacy Policy and KVKK Information Notice (KVKK: Turkish Personal Data Protection Law No. 6698).
1. Parties and acceptance
This agreement is between Etkin.app (“Etkin”, “we”), which operates the Service, and the natural or legal person using the Service (“User”, “you”).
By creating an account, signing in or using the Service, you accept these terms together with the Privacy Policy and the Cookie Policy. If you do not accept them, you should not use the Service.
2. Definitions
- Service: the Etkin.app web application; event creation, online registration, invitations, QR check-in, attendee communication, surveys, certificates, seating plans, reporting and related features.
- Organization: the institution or person organizing events on the Service (the event owner).
- Attendee: a person who registers for or attends an Organization’s event.
- User Content: any text, image, logo, template and data uploaded or created by the User on the Service.
- Plan: the subscription level that determines the scope and quotas with which the Service is used (Free, Pro, Business, Enterprise).
3. Scope and continuity of the Service
Etkin provides a multi-tenant software service (SaaS) for event management. Features vary by plan level; Etkin may add, change or remove features in order to improve the Service. Material changes to the User’s detriment are announced a reasonable time in advance.
Planned maintenance is carried out, as far as possible, during low-usage hours and is announced in advance. The Service is provided without any guarantee of being uninterrupted or error-free; nevertheless, reasonable care is taken to ensure accessibility and continuity.
4. Account creation and security
- You are obliged to provide accurate, current and complete information.
- You are responsible for the security of your account (including your sign-in method, passkey and device access); if you notice any unauthorized use, you must notify us immediately.
- If you register on behalf of an institution, you declare that you are authorized to represent and bind that institution. The organization administrator is responsible for the permissions granted to their own team members.
- You may not share, transfer or sell your account to anyone else.
- Persons under eighteen may not use the Service without the permission of their legal representative.
5. Acceptable use
When using the Service, you agree not to:
- Create or share content that violates applicable legislation or the rights of third parties (copyright, trademark, personality rights, protection of personal data).
- Send unauthorized or unsolicited commercial messages (spam); carry out marketing without attendee consent.
- Attempt unauthorized access to the Service’s infrastructure, reverse engineering, automated data extraction (scraping), overloading, or circumventing security measures.
- Upload malware, impersonate others, or publish misleading or hateful material.
- Publish events that are not real, collect payments from attendees outside the scope of the service, or use the Service for fraud.
- Attempt to circumvent QR verification, quota and payment mechanisms.
6. User content and licence
The rights to User Content belong to you (or to the relevant Organization). Etkin obtains a limited, worldwide, royalty-free right of use solely for the purpose of providing, hosting, displaying and operating the Service. This right ends when your account is closed.
You represent and warrant that you hold all necessary rights and permissions for the content you upload and that the content does not infringe the rights of third parties.
Content you publish on your public event page (event name, description, image, location) may be indexed and shared by search engines.
Claims of copyright or content infringement are subject to the Copyright and Notice-and-Takedown Policy.
7. Attendee data and roles
With respect to the personal data of attendees who register for an Organization’s event, the Organization is the data controller and Etkin is the data processor. Collecting this data and informing attendees are the responsibility of the Organization concerned; Etkin processes this data solely for the purpose of providing the service, within the framework of a separate Data Processing Agreement (DPA).
The Organization is responsible for the fields it adds to the registration form, for the consent obligation regarding commercial electronic messages it sends to attendees, and for the use of attendee data after transferring it to its own systems.
8. Quotas, fair use and third-party integrations
- Each plan has event, attendee, messaging and AI quotas. When a quota is exhausted, no data is lost; only the relevant operation or sending stops. You can purchase additional credits or upgrade your plan.
- Quotas are subject to the principle of fair use to ensure that the service runs sustainably for all users. In the case of usage that strains the infrastructure in an unusual way, Etkin may apply limits after informing you in advance.
- If you connect your own SMS, email (SMTP) or WhatsApp provider account, responsibility for that service’s terms and fees lies with you; Etkin only provides the technical connection.
- Third-party services such as payment, maps and video are subject to their own terms of use.
- You can connect an AI assistant (for example Claude) to your account via the Model Context Protocol (MCP). The connection is off by default and is established only with the authorization you grant on the OAuth consent screen. Within the scope of the organization you are authorized for, the assistant can read your event information, your numerical summaries and the event’s income-expense table; attendee name/email/phone details and IBAN and bank details are not transferred through this interface. The assistant can also create DRAFT events and — each time only after obtaining your separate approval — publish an event or schedule a reminder email to attendees registered for an event. These last two operations produce an irreversible external effect (when publishing, an announcement email may be sent to your followers): they are not carried out without your approval, once you approve an email that has been sent cannot be recalled, and the operation is deemed to have been carried out on your behalf. Reminders use the email channel only, sending starts 15 minutes later at the earliest and can be cancelled from the panel until then; SMS and WhatsApp cannot be sent through this interface. Charging, updating and deleting events, and invitations are done from the panel. The assistant’s own terms of use and privacy policy apply; it is your responsibility to verify the content produced by the assistant before publishing it. The scope of the data transferred and how to revoke the authorization are explained in section 5.1 of the Privacy Policy.
9. Pricing and subscription
For paid plans, the price, payment and cancellation terms are determined by the Preliminary Information Form, the Distance Sales Agreement and the Refund Policy presented at the time of purchase. In the event of a conflict, these specific purchase documents take precedence over these general terms.
The Free plan has no time limit; charging starts only when you explicitly switch to a paid plan.
10. Intellectual property
The Service’s software, design and trademarks, as well as the name and logo “Etkin”, belong to Etkin (or its licensors). These terms do not grant you any ownership right other than the right to use the Service for the term of the agreement.
We may use the feedback and suggestions you give about the Service to improve the product, without incurring any obligation towards you.
11. Exporting your data and closing your account
- You can export your attendee and event data as Excel/CSV on every plan.
- You can close your account at any time. While signed in, you can download a copy of your data and create a deletion request from the Account → My data page.
- Data retention and deletion after termination are subject to the Privacy Policy and the statutory retention periods.
12. Suspension and termination
- In the event of a breach of these terms or of the legislation, a security risk, or a breach of payment obligations, we may suspend or terminate your account. Where possible, prior notice is given and a reasonable period is allowed to remedy the breach.
- Where delay would be harmful (active abuse, a security threat, content that is clearly unlawful), notice may be given afterwards.
- In the event of termination, a reasonable period is allowed for you to export your data.
13. Disclaimer of warranties
The Service is provided “as is” and “as available”. To the extent permitted by applicable law, no warranty of any kind, express or implied, is given, including implied warranties that the Service will be uninterrupted, error-free or fit for a particular purpose. Your rights arising from consumer legislation are reserved.
14. Limitation of liability
To the maximum extent permitted by applicable law, Etkin is not liable for indirect, incidental or consequential damages, or for loss of data or profits.
Etkin’s total liability arising from this agreement is limited to the subscription fees you paid to Etkin in the twelve (12) months preceding the event giving rise to the claim. On the Free plan, this limit is the minimum amount permitted by the relevant legislation.
These limitations do not apply in respect of intent, gross negligence and the mandatory provisions of consumer legislation.
The holding, content and cancellation of the event and the obligations towards attendees belong to the Organization running the event; Etkin is not a party to this relationship.
15. Indemnification
You agree to cover the resulting damages and reasonable defence costs in claims brought against Etkin by third parties because of your User Content or your use of the Service in breach of these terms.
16. Changes
We may update these terms. We notify significant changes through the Service or by email a reasonable time in advance. Continuing to use the Service after a change means that you accept the updated terms. If you do not accept them, you can close your account.
17. Assignment, severability and other provisions
- You may not assign your rights under this agreement without Etkin’s written consent. Etkin may assign the agreement in the event of a merger or transfer of business.
- The invalidity of one provision does not affect the validity of the other provisions.
- Failure to exercise a right does not mean that the right has been waived.
- Notices are given via the email address registered in your account and via info@etkin.app.
18. Governing law and disputes
These terms are governed by the laws of the Republic of Türkiye. In disputes with merchant or corporate Users, the courts and enforcement offices of the place where Etkin’s headquarters is located have jurisdiction.
In consumer transactions, the jurisdiction of the Consumer Arbitration Committees (Tüketici Hakem Heyetleri) and Consumer Courts (Tüketici Mahkemeleri) is reserved; the consumer may apply to the authority at their own place of residence.
